Rather, Google Tag Manager triggers tags originating from other services, provided that these in turn collect data with your consent. In our case, these are the following Google services. If you have not given consent for the aforementioned services, no tags are implemented with Google Tag Manager. However, Google Tag Manager collects your IP address. The explanations given above regarding Google Analytics apply in this respect.

(3) Further information on Google Tag Manager can be found at https://marketingplatform.google.com/about/analytics/tag-manager/use-policy/

3.5.3 Google Ads

(1) We use Google Ads, a service of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland; “Google”), to draw attention to our offerings with the help of advertisements. If you reach our WEBSITE via a Google advertisement, Google Ads stores a cookie on your terminal device.

(2) The advertising materials are delivered by Google via so-called “ad servers”. For this purpose, we and other websites use so-called ad server cookies, by means of which certain parameters for measuring success, such as the display of advertisements or clicks by users, can be measured. Via the Google Ads cookies stored on our WEBSITE, we can obtain information about the success of our advertising campaigns. These cookies are not intended to personally identify you. For this cookie, the following analysis values are typically stored: the unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (a flag indicating that a user no longer wishes to be addressed).

(3) The cookies set by Google enable Google to recognize your internet browser. If a user visits certain pages of an Ads customer’s website and the cookie stored on their computer has not yet expired, Google and the customer can recognize that the user clicked on the advertisement and was redirected to that page. Each Ads customer is assigned a different cookie, so cookies cannot be tracked via the websites of other Ads customers. By integrating Google Ads, Google receives the information that you have accessed the relevant part of our online presence or clicked on an advertisement from us. If you are registered with a Google service, Google can assign the visit to your account. Even if you are not registered with Google or have not logged in, there is a possibility that the provider will learn and store your IP address.

(4) Due to the marketing tools used, your browser automatically establishes a direct connection with Google’s server. It cannot be ruled out that personal data may be transmitted to Google’s servers in the USA. We ourselves do not independently collect personal data in the aforementioned advertising measures; we merely provide Google with the possibility to collect the data. We only receive statistical evaluations from Google, which show which advertisements were clicked how often and at what prices. We do not receive any further data from the use of the advertising materials; in particular, we cannot identify users on the basis of this information.

(5) The legal basis for the processing of personal data in connection with Google Ads is your consent pursuant to Art. 6(1) subpara. 1 lit. a GDPR. We also use cookies or comparable technologies with your consent on the basis of Section 25(1) sentence 1 TTDSG in conjunction with Art. 6(1) subpara. 1 lit. a GDPR.

(6) Google is certified under the “EU-US Data Privacy Framework”. Contact/feedback

(1) If you contact us, for example to share your feedback, your submitted contact data (e.g., first and last name, e-mail address, telephone number) will be processed in order to respond to your inquiries and/or suggestions submitted via the contact form or by e-mail. The processing of your data serves to handle the contact request and to prevent misuse and ensure the security of our information technology systems.

(2) The legal basis for processing the data is Art. 6(1) subpara. 1 lit. f GDPR. If your message aims at concluding a contract, the additional legal basis for processing your data is Art. 6(1) subpara. 1 lit. b GDPR.

(3) Insofar as no statutory retention periods preclude deletion of your personal data, we will delete it as soon as it is no longer required to achieve the purpose for which it was collected.

(4) For inquiries from a business context (B2B), the further information in the Information for Business Partners, apply, and for inquiries related to applications, the information in our Information for Applicants.

5. Subscribing to our newsletter

(1) With your consent, you can subscribe to our newsletter via our website, through which we inform you about our current interesting offers. The offers being advertised are named in the declaration of consent.

(2) The newsletter is sent and managed by the processor marmato GmbH, Wilhelmstraße 4a, 70182 Stuttgart, Germany (“marmato“). For this purpose, it is necessary for us to transmit the data you provided when registering for the newsletter to marmato. This data is stored exclusively on servers in Germany. We have concluded a data processing agreement with marmato pursuant to Art. 28 GDPR. This data is stored exclusively on servers in Germany. marmato has demonstrated its compliance with data protection regulations and data security. Further information on data protection can be found in marmato’s privacy policy at: www.marmato.com/datenschutz/

(3) For subscribing to our newsletter, we use the so-called double opt-in procedure. This means that after you register, we send you an e-mail to the address you provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 25 hours, your information will be deleted. In addition, we store the IP addresses used and the times of registration and confirmation. The purposes of this procedure are to be able to prove your registration and, if necessary, to investigate any possible misuse of your personal data.

(4) The only mandatory information for sending the newsletter is your e-mail address. Providing further separately marked data is voluntary and is used to be able to address you personally. After your confirmation, we store your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6(1) subpara. 1 lit. a GDPR.

(5) You may withdraw your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can declare your withdrawal by clicking the link provided in every newsletter e-mail or by sending a message to the contact details listed in Section 1.

(6) We would like to point out that we evaluate certain actions within the newsletter distribution anonymously, for example how many recipients have opened the newsletter and how often links were clicked. This serves to analyze the content and optimize our newsletter topics. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our WEBSITE and linked to an individual ID. The data is collected exclusively in pseudonymized form; the IDs are therefore not linked to your other personal data, and direct personal identifiability is ruled out. We have a legitimate interest in showing relevant and interesting topics and therefore in measuring the response rate to the topics we present. The legal basis for this is Art. 6(1) subpara. 1 lit. f GDPR. If you do not agree with the anonymous evaluation and wish to object to it, we ask you to unsubscribe from our newsletter. Technically, it is not possible for us to exclude individual recipients from this. After unsubscribing, we store the data purely statistically and anonymously.

(7) We delete your data as soon as it is no longer required to achieve the purpose for which it was collected. After you unsubscribe from the newsletter, we store your e-mail address, the data collected during registration for the newsletter as referred to in para. 2, as well as the date and time of unsubscription, in order to be able to prove that a valid consent to receive the newsletter existed up to the time of unsubscription. We store the data until any possible civil law claim relating to the most recently sent newsletter has become time-barred. The legal basis for this is Art. 6(1) subpara. 1 lit. f GDPR.

6. Data security

(1) We use technical and organizational security measures to protect collected or otherwise processed personal data, in particular against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons. Our security measures are continuously improved in line with technological developments.

(2) Our WEBSITE is encrypted using SSL technology to prevent unauthorized third parties from accessing data. You can recognize the secure transmission by the protocol designation “https://” in the URL bar.

7. Your rights

(1) With regard to the processing of your personal data, you have the rights listed below under letters a–h against us, subject to the statutory requirements. Please contact us or our data protection officer for this purpose. The contact details can be found in Section 1.

a) Right of access

You may request from us, pursuant to Art. 15 GDPR, confirmation as to whether personal data concerning you is being processed by us. In that case, pursuant to Art. 15(1) GDPR, you have the right to access information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom we have disclosed or will disclose the personal data, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification or erasure of your personal data, as well as restriction of processing or objection to processing, the existence of a right to lodge a complaint with a supervisory authority, the origin of the data if we did not collect your data from you, the existence of automated decision-making including profiling, and, pursuant to Art. 15(2) GDPR, the right to be informed about the appropriate safeguards pursuant to Art. 46 GDPR in connection with the transfer of personal data to third countries.

b) Right to rectification

You may request from us, pursuant to Art. 16 GDPR, the immediate rectification and/or, taking into account the purposes of the processing, the completion of your personal data if your data is inaccurate or incomplete.

c) Right to erasure

You may request from us, pursuant to Art. 17 GDPR, the immediate erasure of your personal data if one of the grounds under Art. 17(1) lit. a–f GDPR applies. However, the right to erasure of your personal data does not apply in particular to the extent that processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims (Art. 17(3) GDPR).

d) Right to restriction of processing

You may request from us the restriction of processing of your personal data pursuant to Art. 18 GDPR for as long as we are checking the accuracy of your data that you have disputed; if you refuse the erasure of your data due to unlawful processing and instead request restriction of the use of your data; if you need your data for the establishment, exercise or defense of legal claims; or if you have objected to the processing, for as long as it has not been determined whether our legitimate grounds override yours.

e) Right to notification

Pursuant to Art. 19 GDPR, we will notify all recipients to whom your personal data has been disclosed of any rectification or erasure of your personal data or restriction of processing under Art. 16, 17(1) and 18 GDPR, unless this proves impossible or involves disproportionate effort. You have the right, pursuant to Art. 19 sentence 2 GDPR, to be informed about these recipients by us upon request.

f) Right to data portability

Pursuant to Art. 20 GDPR, you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and to transmit that data to another controller, provided the further requirements of Art. 20 GDPR are met, in particular where this is technically feasible.

g) Right to object

Insofar as we base the processing of your personal data on the legitimate interests pursuant to Art. 6(1) subpara. 1 lit. f GDPR, you may object to the processing pursuant to Art. 21 GDPR. This applies in particular where the processing is not necessary for the performance of a contract with you, which we describe in each case in the description of the offers above. When you exercise such an objection, we ask you to explain the reasons why we should not process your personal data as we do. In the event of your justified objection, we will examine the matter and will either cease processing the personal data or demonstrate to you our compelling legitimate grounds for the processing which override your interests, rights and freedoms, pursuant to Art. 21(1) sentence 2 GDPR. Further processing also remains reserved where the processing serves the establishment, exercise or defense of legal claims.

Of course, pursuant to Art. 21(2) GDPR, you may object at any time to the processing of your personal data for direct marketing purposes, including profiling to the extent that it is related to such direct marketing.

You may inform us or our data protection officer of your objection using the contact details listed in Section 1.

h) Right to withdraw consent

Pursuant to Art. 7(3) GDPR, you have the right to withdraw any data protection consent you may have given us at any time with effect for the future. However, this does not affect the lawfulness of the processing carried out on the basis of your consent up to the time of withdrawal.

(2) If you believe that the processing of your data infringes data protection regulations, you additionally have the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR. Please contact a supervisory authority in the Member State of your place of residence, your place of work or the place of the alleged infringement.

8.
